My PERM is ready to be filed soon. But I was told by my employer's attorney that the salary in the notice of filing is less than the prevailing wage. So my employer will post the notice again with the correct salary for 10 consecutive business days.
I wonder whether my employer has to wait for at least 30 days after the posting's last day to file my PERM even though the recruitment has already completed.
Technically, yes, because that is one of the forms of recruitment which has to be open for the 30 day recruitment period before they can attest no qualified applicants applied.
What happens if some one applies during that 30 days and is not considered and they file a complaint with the DOL? The employer cannot attest to that before allowing the 30 days to expire.
